369 Terms of Use
These terms are the agreement between you and MVAE PERU S.A.C. (RUC 20616227492), which we call "369" or "we" in this text. They govern your use of the 369 app and its services.
1. Acceptance and minimum age
- When you create your account you tick that you accept these terms and the Community Guidelines, which are part of them. If you do not accept them, you cannot use 369.
- To create an account you must be 14 or older, and you state it when you sign up. If you are between 14 and 17, we recommend reviewing these terms with your parent or guardian.
- If we learn that an account belongs to someone under 14, we delete it.
- How we handle your data is in the Privacy Policy.
2. Your account and your username
- You sign up with your email and a password. Look after your password: what is done from your account is your responsibility, unless you tell us someone got in without your permission.
- Your username (the @) is your identity on 369. It must be unique and cannot pass as another person, brand or organization.
- You can change your username, your name and your photo, with a wait between changes. The previous username stays reserved for a while, so nobody takes it to pass as you.
- One person, one account. You may not create accounts to get around a sanction.
- If you delete your account, your username stays reserved for 365 days and is not released before then.
3. License to use the app
- We give you a personal, free, non-exclusive and non-transferable license to use the app on the Apple devices you own or control.
- The app is downloaded from the App Store. In addition to these terms, Apple's standard Licensed Application End User License Agreement applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If the two contradict each other on the software license, Apple's agreement prevails.
- Apple is not a party to these terms and is not responsible for the app or its content.
- You may not copy, modify, decompile or resell the app, or use it in a way that harms the service or other people.
4. Your content
- What you post is yours: your activities, images, videos, comments and your profile.
- For 369 to work, you give us a non-exclusive, free, worldwide license to store, copy, reformat and show your content within 369, to the audience you choose. The license is only for providing the service to you. We do not sell your content and we do not use it in advertising.
- The license ends when you delete that content or your account. There are two exceptions:
- Comments you left on other people's posts stay after you leave, without your name or photo.
- Copies other people saved or shared outside 369 before you deleted it.
- You confirm that you have the right to post what you post: that the photos, videos and music are yours or you have permission, and that the people who appear agree.
- You are responsible for what you post.
5. Zero tolerance for objectionable content and abuse
369 has zero tolerance for objectionable content and for people who abuse others. What is not allowed is in the Community Guidelines: harassment, hate, nudity and sexual content, violence, spam, impersonation, posting other people's data or traces, cheating on metrics, any sexual or exploitative content involving minors, and dangerous challenges.
If you post something like that, we remove it and apply a sanction. Sanctions escalate, and a very serious violation closes the account at once:
| Level | What it means |
|---|---|
| Warning | We reviewed something you posted and it does not follow the rules. Nothing is restricted yet. |
| Limited account | You cannot post, upload activities or comment for 7 days. |
| Suspended account | You cannot post, upload activities or comment for 30 days. |
| Closed account | The account can no longer post or comment, with no end date. We may also delete it. |
Each confirmed violation adds points according to its severity, and points expire over time. Details are in the Community Guidelines.
6. Reports, blocking and moderation
- You can report a profile, a post or a comment. The reported person does not know who reported them.
- You can block an account: they cannot see your profile or open your posts, and you do not see theirs. Blocking also alerts us, so we can review that account.
- We review reports within 24 hours. If the content breaks the rules, we remove it and sanction whoever posted it.
- If three different people report the same content, it is provisionally hidden until we review it.
- If you think a sanction is a mistake, you can ask us to review it (section 10).
- Do not report in bad faith. Using reports to harass someone also breaks the rules.
7. 369 is not medical advice
- 369 is an app to record and share your training. It is not a medical device and does not give medical advice.
- Metrics are estimates. Distance and pace depend on the GPS signal. Calories are estimated with formulas and can be off, more so if you do not give your birth year or there is no heart rate. Heart rate and other data from Apple Health or your watch are what that device recorded.
- You train at your own risk. See a health professional before starting or changing a training plan, especially if you have a medical condition.
- Stay safe while you record: follow traffic rules, do not look at your phone while you move and do not enter dangerous or restricted places.
8. Competitions
- 369 shows a catalogue of competitions run by third parties, and lets you add them to your profile and declare your time.
- 369 does not register anyone or sell entries. Registration, payment, rules, safety and official results are the organizer's responsibility.
- If the organizer gives us their list of entrants, we may mark your entry as verified. You can remove it from your profile at any time.
- The time you declare is yours; it is not an official result. Do not declare false times.
- We are not responsible for changes, cancellations or problems with a competition.
9. Intellectual property and attributions
- The app, the 369 brand, the design, the code and the templates belong to MVAE PERU S.A.C. or to those who licensed them to us. You may not use them without permission, except as allowed by the license in section 3.
- Maps: © Mapbox (https://www.mapbox.com/about/maps) and © OpenStreetMap contributors (https://www.openstreetmap.org/copyright), under the ODbL license.
- Cities: data © GeoNames (https://www.geonames.org), under the Creative Commons Attribution 4.0 license (CC BY 4.0).
- Third-party software licenses are in Settings › about › licenses.
- If you believe something posted on 369 infringes your copyright or trademark, write to hola@369app.lat with the link or a description of the content and why you believe it infringes.
10. Suspension and termination
- You can stop using 369 and delete your account at any time, from the app: profile › settings › account › delete my account.
- We may limit, suspend or close your account if you break these terms or the Community Guidelines, if the law requires it, or if your account puts other people or the service at risk. You can see your account status in Settings › account › account status.
- Review: if you think a sanction is a mistake, write to hola@369app.lat from your account's email, with your username and what you want us to review. We review the case again and answer within 10 business days.
- We may change or stop offering parts of the app. If we shut down the whole service, we will tell you at least 30 days in advance and you will be able to request a copy of your data.
11. Liability
- 369 is offered free of charge and as is. We work to make it work well, but we do not guarantee it will always work, be free of errors, or that the metrics are exact.
- We are not responsible for content posted by other people, although we remove it when it breaks the rules.
- We are not responsible for harm resulting from your training, from a third-party competition or from using the app against these terms.
- None of this limits liability that Peruvian law does not allow to be limited, such as liability for wilful misconduct or gross negligence, nor your rights as a consumer.
12. Changes to these terms
If we change these terms, we publish the new version with its number and date. If the change is significant, we tell you in the app before it takes effect and ask you to accept it. If you do not accept it, you can delete your account.
These terms are also published in Spanish. If the two versions differ, the Spanish version prevails.
13. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Peru. Any dispute is submitted to the judges and courts of Lima Cercado, without prejudice to your right to go to INDECOPI or the relevant authority as a consumer.
